Usage of this site and/or purchasing ANY of our services means that you agree to all current and future policies and copyright expectations. It is YOUR responsibility to stay informed. Period.
This agreement represents the complete agreement and understanding between FreshandFunkyBlogTemplates.com (hereinafter called FAFBT) and the customer (hereinafter called Client or User) and supersedes any other written or oral agreement. FAFBT reserves the right, in its sole discretion, with or without notice, may modify, these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change the services offered. Client or User must comply with FAFBT current “Policies,” as updated from time to time by FAFBT, which can be viewed at FAFBT web site.
We reserve the right to add to or take away from these policies at any time for any reason. It is the client/users responsibility to remain informed. By accessing this website you agree to ALL of our policies. When you purchase anything it is the same as a written contract. Client/User AGREES to abide by ALL of our present and future policies.
MAY NOT PURCHASE FAFBT DESIGNS
You may NOT Purchase ANYTHING on FAFBT that will be used on ANY of the following type of sites; hate, war related, anti God, anti Christian, witchcraft, Pornography, minors, Sexually Explicit content or site, and ALL the like. Period. If you are caught we WILL file charges against you for breach of contract and copyright law violation. Furthermore, we will report you to your host, domain provider, and ALL the like.

All content and graphics are protected by copyright laws. All content and graphics on this site are the sole property of FreshandFunkyBlogTemplates.com and its parent companies. We will seek prosecution for any violation of copyright laws, altered or copied images, content, etc that is taken from this site without purchase or written permission.
Altering Design Work - CLIENT/USER may NOT alter, resize, or change ANY of the graphic/design work (including but not limited to; blog templates, headers, buttons, logos, e-book covers, etc.) of FreshandFunkyBlogTemplates.com without WRITTEN permission. We do not want our images altered for many reasons, the most important being that our name is on it and we want it to remain in the quality that WE designed it. Our reputation and excellence is VERY important.
CLIENT/USER may not use any of the images in the work we provide for any other purposes than what they were created for (including but not limited to; print design, other websites, creating banners and buttons, etc.) WRITTEN permission from FreshandFunkyBlogTemplates.com owners.
Also, these things may infringe on the designer of any images used within a design.
If CLIENT/USER would like a resize, banner or button, or any alteration or addition to a design, simply let us know. We offer these services for a nominal fee.
Failure to comply with ALL copyright terms listed above and below is a direct violation of copyright laws. Please read Section 504(c)(2)(http://www.copyright.gov/title17/92chap5.html#504).
Payment
All payments are due before work FAFBT begin. We will accept Pay Pal, Personal Checks, and US Postal Money Orders. All payments must be CLEARED before work will begin.
Refunds
NO refunds are provided once design process has begun. Period.
Premade Designs
All of our premade designs are sold more than once. That is how we keep our prices so low. Although we are primarily a premade design site, we will do custom orders. If you want a custom blog template, please contact us for a quote.
Revisions for Custom Orders
While we want to make our customers happy, we can not be held liable for any service that we provide for any reason. We will take the time to discuss your wishes and get it right the first time.
FAFBT will do up to ONE revision for each custom item purchased. And/Or, up to ONE revision for extras purchased. Additional revisions are $5-$25 each and up depending on what it entails.
Link Back
We will seek prosecution for any violation of copyright laws and/or breach of contract.
ALL blogs purchased from FAFBT are REQUIRED to keep the FOOTER link back to FAFBT UNTOUCHED, viewable, active, and IN Tact. Period.
ALL blogs purchased from FAFBT are REQUIRED to keep the CUSTOM DESIGN CREDIT SIDEBAR 125×125 button UNTOUCHED, with link back to FAFBT viewable, active, and IN Tact. Period.
ALL headers purchased from FAFBT are REQUIRED to have a FOOTER text link (ie: Header Designed by Fresh and Funky Blog Templates ‘linked to our home page’) OR a 125×125 button in your sidebar linked to our home page. Period.
Custom banner or buttons purchases do not require a link back. However, if you place a link back to FAFBT on your home page you will be eligible for 10%-15% off any future purchases. And, we will appreciate it!
ALL Newsletter templates purchased from FAFBT are REQUIRED to keep the FOOTER link back to FAFBT UNTOUCHED, viewable, active, and IN Tact. Period.
Images
We use royalty free images for most of our work. You agree to keep a link on your site giving credit to where the image came from. Failure to do so could cause you major legal trouble from the image owner. You should also know that these images may be elsewhere on the web. We will not create themes with the same images. However, the images are available for others to use. If you wish to have an image that is exclusive, let us know and we will tell you what the additional cost would be.
FAFBT will NOT be held liable under ANY circumstances for any Image copyright law violations. Period.
It is the CLIENT/USERS responsibility to be informed.
LIMITED LIABILITY
a. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT AND UNDER NO LEGAL THEORY SHALL FAFBT BE LIABLE TO THE ACCOUNT HOLDER FOR ANY BUSINESS LOSS, REVENUES DECREASE, EXPENSES INCREASE, COSTS OF SUBSTITUTE PRODUCTS/SERVICES, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE USE OF, OR INABILITY TO USE, ANY OF FAFBT SERVICES, EVEN IF FAFBT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL FAFBT LIABILITY EXCEED FIVE DOLLARS. THIS LIMITATION OF LIABILITY AND RISKS IS REFLECTED IN THE PRICE OF FAFBT SERVICES.
b. The CLIENT/USER acknowledges that FAFBT makes an honest effort to keep the information available on FAFBT’s systems accurate. However, FAFBT can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity for the data and/or information available. Use of information obtained from or through FAFBT is at the risk of the CLIENT/USER.
c. The CLIENT/USER acknowledges that the information available through the interconnecting networks may not be accurate. FAFBT has no ability or authority over the material. FAFBT can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity of the data and/or information residing on or passing through these networks. Use of information obtained from or through FAFBT services is at the risk of the CLIENT/USER.
d. The CLIENT/USER understands, agrees and acknowledges that FAFBT makes an honest effort to provide the CLIENT/USER with Technologies, Developments and Innovations that part of them are being licensed, or co-branded, from or by, third-party entities. However, FAFBT can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, reliability or validity for the application(s), data and/or information involved in such items. FAFBT specifically disclaims all warranties of merchantability and and fitness for a particular purpose. The use of these application(s), data and/or information obtained from or through FAFBT, or any other referred third-party, directly or indirectly, is at the risk of the CLIENT/USER.
e. The CLIENT/USER understands, agrees and acknowledges that FAFBT will use its best efforts to maintain a full time Internet presence for CLIENT/USER. The network may be down due, but not limited to, utility interruption, equipment failure, natural disaster, acts of God, or human error. CLIENT/USER agrees that these events may or may not occur and CLIENT/USER will hold FAFBT, its Parents, Subsidiaries, Affiliates, Executives, Directors, Officers, Managers, Employees, Successors, Assigns, Consultants and Agents, free and harmless from any damages incurred in any event of any type of loss resulting from any reason whatsoever. Uses of FAFBT service is at the risk of the CLIENT/USER.
Use of Material
a. Public Domain materials (e.g., images, text, and programs) may be downloaded or uploaded using FAFBT services. CLIENT/USER may also re-distribute materials in the public domain. The CLIENT/USER assumes all risks regarding the determination of whether the material is in the public domain.
b. As provided by United States federal law, Canada federal law and by International law, copyrighted materials (e.g., images, text, and programs) may not be uploaded using FAFBT services without the permission of the copyright holder. Copyrighted materials may be downloaded for personal use. Except as expressly permitted, materials under copyright may not be distributed to others. Copyrighted material may not be changed nor can the author attribution notices nor the copyright notices be modified.
Additionally
We reserve the right to refuse anyone for any reason. Period. FAFBT will NOT create anything for porn, hate, witchcraft, or any type of site that WE feel is not what we want to be associated with.
We cannot be held liable for any client that does not read these policies. Usage of this site AUTOMATICALLY puts the client IN AGREEMENT with all policies now and in the future. Period.
